Migrant Identification in the
Age of Blockchain: Digital Identity,
Institutional Invisibility and Fundamental Rights

Abstract
In contemporary legal systems, identity functions as the gateway to rights. Access to healthcare, education, employment, asylum procedures and judicial protection presupposes formal recognition by public authorities. Legal personality is not merely a symbolic status; it constitutes the condition for inclusion within institutional frameworks. For millions of migrants, asylum seekers and stateless persons, this recognition is fragile or entirely absent. The loss, destruction or absence of official documentation generates a condition of institutional invisibility in which individuals exist physically but remain excluded from effective legal protection.
The governance of migration flows therefore reveals a structural tension: while States require reliable identification mechanisms for security, administrative and legal purposes, many displaced persons are unable to satisfy these requirements through traditional documentary systems. In the absence of recognized proof of identity, access to rights becomes conditional, delayed or denied. This dynamic may contribute to irregular migration pathways and increase vulnerability to exploitation and trafficking.
Within this context, blockchain-based digital identity infrastructures have been proposed as complementary solution. Distributed ledger technologies offer a decentralized and tamper-resistant architecture capable of supporting the issuance and verification of digital credentials without exclusive reliance on a single national registry. The model of Self-Sovereign Identity (SSI) introduces a user-centered paradigm in which individuals retain control over their credentials through digital wallets. These systems rely on cryptographic proofs that allow selective disclosure of specific attributes while minimizing unnecessary data exposure.
For migrants operating across borders, such portability may offer continuity of identity even when physical documents are lost or when institutional infrastructures in the country of origin are unstable or inaccessible. From an administrative perspective, SSI-based systems may enhance efficiency, interoperability and trust.
However, the legal implications remain complex. The immutability of blockchain infrastructures raises concerns under data protection principles, particularly about rectification and erasure. Decentralized governance models also complicate the attribution of responsibility within existing accountability frameworks.
Beyond data protection challenges lies a more fundamental normative issue: identity is dynamic. Legal status evolves over time, particularly in migration contexts. A digital infrastructure that rigidifies identity attributes risks freezing individuals within administrative categories, thereby reinforcing structural vulnerability instead of mitigating it.
Blockchain-based SSI systems may therefore contribute to restoring legal continuity and facilitating access to rights for undocumented migrants only under strict normative conditions. At a minimum, these include independent public oversight, accessibility and inclusiveness for individuals with limited digital literacy or technological access, and the existence of effective mechanisms for correction, limitation or functional reversibility despite technical immutability.
Ultimately, the central question is not whether blockchain can technically improve identification procedures, but whether digital identity infrastructures can be designed in a manner consistent with human dignity and the evolving nature of legal status. Technological resilience must not substitute political responsibility. If embedded within a rights-oriented legal framework, blockchain-based identity systems may reduce institutional invisibility. If governed primarily by efficiency or control imperatives, they risk generating new forms of exclusion.

Grazie per la domanda. Secondo me sì, i sistemi di self-sovereign identity basati su blockchain potrebbero aiutare i migranti senza documenti a dimostrare alcuni attributi o credenziali in modo portabile e verificabile. Tuttavia, da soli non possono creare un’identità giuridicamente riconosciuta, perché la loro efficacia dipende dal riconoscimento da parte delle istituzioni.
Very interesting and prone to Human RIghts Challenges in the future, the problem that i foresee is: Who oversees the blockchain administrators and how easy and fast will be the change of status. Regarding the European Union its migration control would be overridden by the Big IA corporations which operate outside its borders.

Una possibile risposta alla questione della supervisione potrebbe essere l’applicazione di modelli di governance ibrida, in cui un’infrastruttura tecnologica distribuita rimane comunque inserita in un quadro di supervisione istituzionale e regolazione pubblica. Nei sistemi basati su credenziali verificabili, il cambiamento di status potrebbe avvenire attraverso l’aggiornamento o la sostituzione delle credenziali, resta tuttavia aperta la questione di quanto questi processi possano essere rapidi ed efficaci. Infine, proprio per evitare che tali infrastrutture siano guidate solo da attori tecnologici privati, diventa centrale l’aggiornamento dei quadri regolatori dell’Unione Europea.
