Abstract
For a period, exceeding tow year, the United Nations, through the Security Council and the International Court of Justice, has been unsuccessful in its efforts to halt the aggression against Gaza and the genocide, or to ensure respect for the rules of international law and halt its violations by the brutal machinery of the occupying army.
This phenomenon can be attributed to the preeminence of the United States and a select group of other major powers within the United Nations Security Council. This preeminence has exerted a significant influence over the course of events at the United Nations. They wield their authority to exercise the right of veto over Security Council resolutions in a manner that contravenes the principles of sovereign equality among states as articulated within the UN Charter. This is achieved by conferring upon five nations the prerogative to impede the implementation of Security Council resolutions, thereby favoring their own agendas, even when such actions might be at odds with the overarching interests of the international community. This dynamic has contributed to the perpetuation of hostilities in Gaza and the ongoing targeting of its civilian population, thereby undermining the efficacy of international law. To this end, the present study aims to shed light on the matter by offering several key findings on the subject, which are followed by a set of recommendations that are intended to play a crucial role in reinvigorating the United Nations’ role in enforcing and consolidating respect for the rules of international law. The overarching objective here is to ensure that these principles become the foundational standard in the realm of international affairs and the resolution of international conflicts, which have the potential to imperil international peace and security.
